Notification of interest and costs
Before you issue a collection claim it is important to notify the debtor in writing of the interest and costs in a final notice.
Use the text below, or words with a similar content, in your final notice: "Because the term of payment of our invoices has long since expired, we hereby request payment by return of post. If the outstanding amount is not credited to our account within 8 days from today, we will be obliged to pass on a claim for collection. All related costs, both in and out of court, are payable by you. In that case we will also claim the interest from the due date."
Timely and appropriate handing over of General Terms and Conditions
Simply referring to the General Terms and Conditions on the invoice does not suffice in the event of a dispute with the debtor. It is always wise to "hand over" the General Terms and Conditions officially. This can be done by enclosing them with the order or by sending them by registered letter to the client. In any event it is important that the debtor should be deemed to have been able to become familiar with the General Terms and Conditions before the order was placed.
